These General Terms and Conditions supplement the currently valid Conditions of Carriage and Fare Regulations of VLK.
1. General
(1) The ticket shop for purchasing mobile tickets of Verkehrsverbund Landkreis Kelheim (hereinafter referred to as “VLK”) is integrated into the VLK apps for mobile devices. Selected fare products can be purchased online in the VLK ticket shop. Use of the VLK ticket shop is exclusively governed by these “General Terms and Conditions for Mobile Tickets” (hereinafter referred to as “GTC”). By using the VLK ticket shop, the customer agrees to the provisions set out below.
(2) These GTC apply to the purchase of tickets in the VLK ticket shop and supplement the currently valid Conditions of Carriage and Fare Regulations of VLK.
(3) VLK reserves the right to change, correct and/or further develop information and the products described therein at any time without prior notice, provided this is reasonable for the customer. This also applies to adjustments serving technical progress.
(4) Where these GTC do not contain explicit provisions, the applicable statutory regulations shall apply.
(5) For the processing of the e-payment service for sales via the VLK app shop, VLK uses the IT service provider Mentz GmbH, Grillparzerstraße 18, 81675 Munich, and the financial services company LogPay Financial Services GmbH, Schwalbacher Straße 72, 65760 Eschborn (hereinafter also referred to as “LogPay”). For this purpose, the personal data required for contract processing are transmitted to the named service providers.
(6) The collection of payment claims for purchased tickets is carried out by LogPay, to whom all payment claims, including any ancillary claims and fees, have been sold and assigned (notice of assignment). LogPay is a third-party beneficiary of the following provisions and is also entitled to collect claims in its own name and for its own account.
2. Registration
(1) In order to use the e-payment service for sales via the VLK app shop, the customer must register once in the VLK ticket shop and provide the following information truthfully and completely:
a. Name and full address
b. Date of birth
c. Email address
d. Preferred payment method
e. Credit card details (in case of credit card payment)
f. Email address of the PayPal account
(2) The customer undertakes to update essential contractual data (in particular address and payment method) immediately in the personal login area in the event of changes. If the customer fails to comply, LogPay is entitled to charge the customer for any additional expenses incurred.
(3) Depending on the customer’s age, use of the VLK ticket shop may be restricted: Use of the VLK mobile shop is exclusively available to natural persons with full legal capacity.
(4) There is no entitlement to registration or use of the VLK ticket shop.
(5) Account deletion
The customer may terminate their customer account in the VLK app with Verkehrsverbund Landkreis Kelheim at any time without notice electronically via email to info@meinvlk.de or in writing. Outstanding claims against the customer (e.g., billing of unpaid journeys) remain unaffected. Verkehrsverbund Landkreis Kelheim may terminate the customer account at any time in writing or by email to the address provided by the customer, observing a notice period of 14 days.
3. Order and Conclusion of Contract
(1) The contract is concluded in German.
(2) By placing an order, the customer submits an offer to conclude a purchase contract. The order is placed by pressing the “Buy now” button in the VLK app.
(3) The contract is concluded with VLK. The contract is concluded by transmission of a confirmation via the selected delivery channel (e.g., email) as purchase confirmation by the transport company.
(4) The customer is obliged to pay the ticket price due upon conclusion of the contract.
(5) The purchase price is due immediately.
4. Ticket Purchase and Use
(1) The VLK ticket shop is accessible via the VLK app. The VLK app is available free of charge for iOS and Android.
(2) Valid tickets purchased via the VLK ticket shop are stored on the device used for purchase and can be accessed there at any time. Use on other devices is not possible. Strip ticket credit does not constitute a valid ticket and can be converted into a valid ticket when an internet connection is available.
(3) The customer is responsible for ensuring sufficient hardware and software equipment so that the VLK app and ticket shop can be properly displayed and operated.
(4) Tickets are valid for immediate departure unless a specific validity period is indicated.
(5) Refund, cancellation or exchange of mobile tickets is excluded.
(6) Mobile tickets must be presented to operating staff upon request in such a way that all information is complete, clearly legible and verifiable.
(7) The mobile ticket is valid only in combination with the required control medium (official identification document). Purchase after departure is not permitted.
(8) Tickets purchased or activated after departure will not be recognized and an increased fare will be charged according to applicable regulations.
(9) If proof of ticket cannot be provided due to device failure (e.g., technical malfunction, empty battery), this is treated as travel without a valid ticket.
(10) If the VLK ticket shop is unavailable or the download is faulty, the user must purchase a valid ticket by other means before departure.
(11) The user must ensure compatibility of their device. If proper display is not possible, the ticket is invalid.
(12) VLK and its service providers assume no costs incurred directly or indirectly through use of the ticket shop products.
(13) The order confirmation email does not constitute an invoice. The invoice can be downloaded in the VLK app under “My Tickets”.
5. Right of Withdrawal
(1) There is no right of withdrawal for purchased mobile/online tickets, as the regulations for distance contracts do not apply to passenger transport contracts. Purchased tickets cannot be returned, revoked or canceled.
6. Payment
(1) All payment methods are available only to persons over 18 years with full legal capacity.
(2) The customer may choose between:
a. Credit card (Visa, MasterCard or AMEX)
b. PayPal
(3) Other payment methods are excluded.
7. Liability for Hardware and Software Damage
(1) Failed transactions due to defective hardware or software of the customer will be fully charged if server-side transfer was successful. VLK assumes no liability for damages unless caused intentionally or by gross negligence.
8. Data Protection
(1) The privacy policy of the VLK app with integrated ticket shop applies.
9. Dispute Resolution
(1) VLK is not obliged to participate in dispute resolution proceedings before a consumer arbitration board. The EU online dispute resolution platform is available at: http://ec.europa.eu/consumers/odr/. Email: ticketshop@meinvlk.de
10. Final Provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) If individual provisions are invalid, the remaining provisions remain unaffected.
(3) Place of performance and jurisdiction, where legally permissible, is Kelheim.
